Terms of Service

These terms govern a dental clinic’s authorized use of SmivIQ, an AI-assisted growth and clinic operations platform provided by Yogesh S Surwase, the individual operator and contracting party. References to SmivIQ in these terms mean this product and its operator. The commercial agreement accepted by a clinic may include additional terms; where there is a conflict, the signed agreement controls.

SmivIQ is a pilot / early-access software product independently operated in India by Yogesh S Surwase. For product, privacy, or data deletion enquiries, contact smiviq.support@gmail.com.

Authorized use

Clinics must provide accurate account information, assign access only to authorized people, use one account per person, protect credentials, and promptly revoke access that is no longer appropriate. Owners control clinic-level connections such as Meta and WhatsApp authorization.

Clinic responsibility and clinical care

The clinic remains solely responsible for patient care, clinical decisions, informed consent, diagnosis, prescribing, treatment plans, record accuracy, regulatory duties, and emergency handling. SmivIQ is not a dentist, medical provider, emergency service, or substitute for professional judgment.

AI operational boundary

SmivIQ’s AI supports front-desk and operational work. It may help with clinic information, services, availability, scheduling workflows, reminders, follow-up, and operational summaries when enabled. It must not be used to diagnose, prescribe, interpret X-rays, or autonomously decide whether or how clinical treatment is needed. Clinics must review outputs and use human takeover when appropriate.

Acceptable use

Users must not bypass security or access controls, access another clinic’s information, submit unlawful or harmful content, misuse patient information, interfere with the service, probe credentials, impersonate another person, or use the service for unsolicited communications contrary to patient choices or applicable rules.

Patient communications

Clinics are responsible for having an appropriate basis to contact patients, keeping contact details accurate, honoring consent and opt-out requirements, choosing approved Meta templates where required, and ensuring messages are suitable for the clinic-patient relationship.

Third-party services

Features may depend on Meta, WhatsApp, OpenAI, authentication, infrastructure, and other providers. Availability, eligibility, review, message delivery, templates, coexistence, and policy enforcement may be controlled by those providers. Their terms also apply, and SmivIQ cannot promise their uninterrupted availability or approval.

Service limitations

The service may change, experience interruptions, or produce incomplete AI output. Database and backend controls remain authoritative for supported mutations, but users must still verify clinically or commercially important information. Pilot and preview functionality may have additional limits communicated to the clinic.

Fees

Pricing, payment timing, taxes, renewals, refunds, and usage limits apply only when stated in a separate order form or commercial agreement. These public terms do not invent a price or billing commitment.

Privacy and data

Use of information is described in the Privacy Policy. Each clinic must supply lawful instructions and appropriate notices for information it places in SmivIQ. Requests for deletion are described on the data deletion page.

Suspension and termination

Access may be suspended or terminated for security risk, unlawful use, material breach, provider restrictions, or as agreed commercially. On termination, access stops and data is handled according to the privacy policy, clinic instructions, applicable law, security needs, and any governing agreement.

Pilot terms

SmivIQ is currently offered for pilot and early-access use. These public terms do not specify a contractual liability cap, warranty exclusion, governing-law choice, or dispute forum. Any additional terms must be set out in an agreement accepted by the clinic and Yogesh S Surwase. Nothing in these terms excludes rights or obligations that cannot lawfully be excluded.
